FAQ
India FATCA & CRS questions
Something else? Ask our team
What is Form 61B?
Form 61B is India’s reporting form for FATCA and CRS. Financial institutions file it electronically with the Income Tax Department, as XML generated against the Form61B.xsd schema.
Is a GIIN mandatory on Form 61B?
Yes for Report Type 01 (FATCA): the GIIN must be reported in Part A. No for Report Type 02 (CRS).
Which Report Type code should I use?
Use 01 for FATCA and 02 for CRS. The code goes in the <ReportType> element of the StatementDetails section.
What is the correct ITDREIN format?
The ITDREIN is 16 characters: XXXXXXXXXX.YZNNN, which is the 10-character PAN or TAN, a dot, a 2-character form code and a 3-digit sequence number. Example: AAACN1234Z.CB001. A suffix shorter than 5 characters is invalid.
Why is my Form 61B XML being rejected?
Common causes: an ITDREIN that isn’t 16 characters, a missing TIN for a US-resident legal entity, the wrong ConstitutionType (for example I for a company), an Assessment Year that doesn’t match the reporting period, and elements out of the XSD sequence.
Who signs and uploads the file?
The file must be digitally signed (DSC) by your organisation’s Designated Director or Principal Officer. Novus prepares the file; the signature and final submission must be authorised by your official signatory.
Do I use my own ITDREIN?
Yes. The ITD requires the reporting entity to be the registered filer, so the filing is made under your entity’s own ITDREIN and PAN. Novus generates the compliant XML for it.
We’re a consultant filing for several clients. Can we use one ITDREIN?
No. Each financial institution must have its own ITDREIN, generated through its own PAN login, and its file is uploaded under that client’s credentials.
Do Indian FIs need to register with foreign tax authorities?
No. Indian FIs file CRS and FATCA centrally with the Income Tax Department, which exchanges the data with the relevant countries.
